On Further Constructive Cooperation of Ukraine with the North Atlantic Treaty Organization
In order to continue constructive partnership of Ukraine with the North Atlantic Treaty Organization on all issues of mutual interest, in particular partnership in the framework of Annual National Programs, agreed implementation of activities in this area in line with items 3 and 28, Part 1 of the Constitution of Ukraine I decree:
1. To set up the following positions responsible for promoting agreed fulfillment by the Central Executive Authorities and other government bodies of tasks aimed at further constructive partnership of Ukraine with North Atlantic Treaty Organization on issues of mutual interest:
National Coordinator for Ukraine’s Partnership with North Atlantic Treaty Organization in the Sphere of Foreign Policy and Economy;
National Coordinator for Ukraine’s Partnership with North Atlantic Treaty Organization in Defence and Military Sphere;
National Coordinator for Ukraine’s Partnership with North Atlantic Treaty Organization in the Sphere of Resources (Finances);
National Coordinator for Ukraine’s Partnership with North Atlantic Treaty Organization in the Sphere of Security;
National Coordinator for Ukraine’s Partnership with North Atlantic Treaty Organization in the Legal Sphere.
2. To approve Provisions on National Coordinators for Ukraine’s Partnerships with North Atlantic Treaty Organization (attached).
3. To establish under the President of Ukraine a Commission for Ukraine’s Partnership with North Atlantic Treaty Organization.
4. To approve Provisions on a Commission for Ukraine’s Partnership with North Atlantic Treaty Organization (attached).
5. To appoint Kostiantyn Hryshchenko, Minister for Foreign Affairs of Ukraine, the Chair of the Commission for Ukraine’s Partnership with North Atlantic Treaty Organization.
The Chair of the Commission is to make proposals within two weeks on appointments of the National Coordinators for Ukraine’s Partnership with North Atlantic Treaty Organization and members of the Commission.
6. The Ministry of Foreign Affairs of Ukraine is to provide proper coordination of the Central Executive Authorities actions aimed at foreign policy implementation on furthering Ukraine’s constructive partnership with North Atlantic Treaty Organization on all issues of mutual interest, in particular, partnership in the framework of Annual National Programs.
7. To disregard as those that lost their validity:
The Decree by the President of Ukraine of 26 February 2003 № 169 “On Ukraine’s Authorized Representative for European and Euro Atlantic Integration”;
Article 1 of the Decree by the President of Ukraine of 5 July 2003 № 573 “On Support to Activities of Ukraine’s Authorized Representative for European and Euro Atlantic Integration;
The Decree by the President of Ukraine of 13 March 2006 № 215 “On the National System of Coordination of Ukraine’s Cooperation with NATO”;
The Decree by the President of Ukraine of 15 December 2006 № 1085 “On some Issues of the National System of Coordination of Ukraine’s Cooperation with NATO”;
The Decree by the President of Ukraine of 4 May 2007 № 380 «Issues of the National Coordinators for Ukraine’s Partnership with NATO »;
Article 3 of The Decree by the President of Ukraine of 2 April 2010 № 496 “On Disbanding the Interagency Commission for Ukraine’s Preparation to NATO Accession”.
8. This Decree enters into force at the day of its publication.

PROVISIONS

On National Coordinators for Ukraine’s Partnership with North Atlantic Treaty Organization
1. National Coordinator for Ukraine’s Partnership with North Atlantic Treaty Organization in the Sphere of Foreign Policy and Economy; National Coordinator for Ukraine’s Partnership with North Atlantic Treaty Organization in the Sphere of Defence and Military Issues; National Coordinator for Ukraine’s Partnership with North Atlantic Treaty Organization in the Sphere of Resources (Finances); National Coordinator for Ukraine’s Partnership with North Atlantic Treaty Organization in the Sphere of Security; National Coordinator for Ukraine’s Partnership with North Atlantic Treaty Organization in the Legal Sphere (hereinafter – National Coordinators) are specially authorized persons who act for the benefit of coordinated fulfillment by Central Executive Authorities and other government bodies of tasks related to continued constructive Ukraine’s partnership with North Atlantic Treaty Organization on issues of mutual interest.
2. National Coordinators are guided in their actions by the Constitution and Laws of Ukraine, Acts of the President of Ukraine, Cabinet of Ministers of Ukraine, international treaties signed by Ukraine and these Provisions.
3. National Coordinators in relevant areas:
Promote coordinated fulfillment by Central Executive Authorities and other government bodies of tasks related to continued constructive Ukraine’s dialogue with North Atlantic Treaty Organization on issues of mutual interest, including drafting proposals to ANPs, Individual Partnership Programs, sectoral partnership plans and implementation of those programs and plans;
Participate in preparation of activities of relevant Central Executive Authorities and other government bodies aimed at continued constructive Ukraine’s partnership with North Atlantic Treaty Organization on issues of mutual interest;
Support proper preparation and participation of delegations and representatives of Ukraine in meetings of Joint Working Groups of Ukraine and North Atlantic Treaty Organization in agreed areas of partnership as well as in consultations and expert meetings with representatives of North Atlantic Treaty Organization;
Draft and submit to the Commission for Ukraine’s partnership with North Atlantic Treaty Organization (hereinafter- Commission) proposals on further development of Ukraine’s constructive partnership with North Atlantic Treaty Organization on all issues of mutual interest, prepare relevant materials for the Commission and draft decisions by the Commission;
Inform relevant central executive authorities and other government bodies on decisions taken by the Commission;
Monitor implementation of ANPs, Individual Partnership Programs, sectoral partnership plans, action plans on ANPs’ implementation; make proposals with regard of planned activities’ implementation and submit them to the Commission.
4. The National Coordinators shall be appointed as follows:
National Coordinator for Ukraine’s Partnership with North Atlantic Treaty Organization in the Sphere of Foreign Policy and Economy – First Deputy Minister or Deputy Minister for Foreign Affairs of Ukraine;
National Coordinator for Ukraine’s Partnership with North Atlantic Treaty Organization in Defense and Military Sphere – First Deputy Minister or Deputy Minister of Defense of Ukraine;
National Coordinator for Ukraine’s Partnership with North Atlantic Treaty Organization in the Sphere of Resources (Finances) – First Deputy Minister or Deputy Minister of Finance of Ukraine;
National Coordinator for Ukraine’s Partnership with North Atlantic Treaty Organization in the Sphere of Security – First Deputy or Deputy Chair of Security Service of Ukraine;
National Coordinator for Ukraine’s Partnership with North Atlantic Treaty Organization in the Legal Sphere – First Deputy Minister or Deputy Minister of Justice of Ukraine.
National Coordinators shall be appointed by the President of Ukraine upon submission by the Chair of the Commission for Ukraine’s Partnership with North Atlantic Treaty Organization.
5. National Coordinators are members of the Commission and personally participate in its meetings.
National Coordinators may not delegate their authority to other persons.
National Coordinators act on a non-profit basis.
6. The Commission ensures agreed activities of National Coordinators.

PROVISIONS


On the Commission for Ukraine’s Partnership with North Atlantic Treaty Organization
1. The Commission for Ukraine’s Partnership with North Atlantic Treaty Organization (hereinafter – Commission) is an auxiliary body of the President of Ukraine established in accordance with item 28, Part 1, Article 106 of the Constitution of Ukraine.
2. The Commission in its activities is guided by the Constitution and Laws of Ukraine, Acts of the President of Ukraine, Cabinet of Ministers of Ukraine, international treaties signed by Ukraine and these Provisions.
3. The main tasks of the Commission are:
Monitoring, analysis and evaluation of the state of Ukraine’s partnership with North Atlantic Treaty Organization, in particular in the framework of ANPs, Individual Partnership Programs, sectoral action plans, action plans on ANPs’ implementation;
Ensuring agreed activities of National Coordinators for Ukraine’s Partnership with North Atlantic Treaty Organization (hereinafter – National Coordinators);
Drafting and making according to the existing procedure proposals to the President of Ukraine on further development of Ukraine’s constructive partnership with North Atlantic Treaty Organization on all issues of mutual interest, optimization of coordinating mechanism for Central Executive Authorities and other government bodies in this area, drafting legal and regulatory acts on these issues and making conclusions on expediency to adopt such legal and regulatory acts.
4. In order to fulfill its tasks the Commission has a right to:
Provide recommendations on fulfillment of tasks by the Central Executive Authorities and other government bodies in relevant areas of Ukraine’s partnership with North Atlantic Treaty Organization;
Obtain according to the existing procedure from Central Executive Authorities and other government bodies, state enterprises, agencies and organizations necessary information, documentation and materials;
Engage according to the existing procedure employees of the executive authorities, academics and experts into activities of working groups set up by the Commission;
Invite to its meetings and engage into discussions officials from the government authorities, agencies and organizations;
Organize and conduct round-table discussions, debates, meetings on issues within the competence of the Commission.
5. In the process of fulfilling its tasks, the Commission interacts with other auxiliary bodies and services established by the President of Ukraine and with the Staff of National Security and Defense Council of Ukraine.
6. The Commission consists of the Chair, Deputy Chair, Secretary and other members who participate in its work on a non-profit basis.
The Chair of the Commission is the Minister for Foreign Affairs of Ukraine.
The Deputy Chair of the Commission is the National Coordinator for Ukraine’s Partnership with North Atlantic Treaty Organization in the Sphere of Foreign Policy and Economy.
The members of the Commission are the other National Coordinators as well as representatives of the Administration of the President, Cabinet Secretariat, and the Staff of National Security and Defence Council of Ukraine.
The Secretary of the Commission is the Director of Directorate General for Euro-Atlantic Cooperation and New Challenges of the Ministry of Foreign Affairs of Ukraine.
Personal structure of the Commission is approved by the President of Ukraine.
7. The Chair of the Commission:
Guides the Commission’s activities and defines the work procedures;
Convenes meetings of the Commission and chairs at its meetings;
Represents the Commission in relations with Ukraine’s government authorities, enterprises, agencies, organizations and media;
Reports to the President of Ukraine on the results of the Commission’s work on the quarterly basis;
Makes proposals, if necessary, to the President of Ukraine on the changes of personal structures of National Coordinators, number and composition of working groups set up by the Commission;
Informs the public through media on the results of its work on a quarterly basis.
In case of absence of the Chair of the Commission its meetings are convened and chaired by the Deputy Chair.
The organizational support of the Commission’s activity is provided by its Secretary.
8. In order to fulfill the Commission’s tasks it sets up the following working groups headed by relevant national coordinators:
Working group on political and economic issues;
Working group on defence and military issues;
Working group on resources (finances);
Working group on security;
Working group on legal issues.
The working groups include the representatives of the following bodies:
Working group on political and economic issues – Ministry of Economy, Ministry for Foreign Affairs, Ministry of Defense, Ministry of Education and Science, Ministry of Fuel and Energy, Ministry of Justice, Security Service, State Committee for TV and Radio Broadcasting, State Service of Export Control, Staff of the National Security and Defence Council and Central Electoral Commission (upon agreement);
Working group on defence and military issues – Ministry of Interior, Ministry for Foreign Affairs, Ministry of Economy, Ministry of Defence, Ministry of Industrial Policy, Ministry of Transport and Communications, Ministry of Emergencies, Ministry of Finance, Security Service, Foreign Intelligence Service, Administration of the State Border Guard Service of Ukraine, Staff of the National Security and Defence Council;
Working group on recourses (finances) – Ministry of Economy, Ministry for Foreign Affairs, Ministry of Defence, Ministry of Labor and Social Policy, Ministry of Industrial Policy, Ministry of Finance, Ministry of Justice, State Customs Service, State Tax Administration, State Committee for Financial Monitoring, Staff of the National Security and Defence Council, National Bank of Ukraine (upon agreement);
Working group on security – Ministry for Foreign Affairs, Ministry of Defence, Ministry of Justice, Security Service, Foreign Intelligence Service, State Service of Special Communications and Information Protection, Staff of the National Security and Defence Council;
Working group on legal issues – Ministry for Foreign Affairs, Ministry of Defence, Ministry of Justice, Administration of the State Border Guard Service of Ukraine, Staff of the National Security and Defence Council.
Proposals on personal structure of working groups are made by the relevant National Coordinators upon proposals made by the heads of the bodies to be represented in the working groups.
Personal structure of the working groups is approved by the Commission upon submission by the relevant national coordinators.
The Commission decides on the procedure of working groups’ activity.
9. The main organizational form of the Commission’s activity is meetings which are held if necessary but not less frequently than once every three months.
The Commission’s meetings are valid in case of presence of more than a half of its members.
10. As a result of consideration the Commission takes a decision.
The Commission’s decision is regarded as adopted if it was voted for by the majority of its members present at the meeting. In case of even distribution of votes the Chair’s vote is the decisive one.
The Commission’s decision is legalized by the Protocol signed by the chairman of the meeting and the Commission’s Secretary.
The Commission’s decisions may be sent for consideration to the Central Executive Authorities and other government bodies.
The Commission’s decisions can be implemented through the Acts of the President of Ukraine according to the existing procedure.
11. The Commission uses blank forms with its name on them.
